Boedeker Challenges Opponent's Residency In District 81 Race

, a Republican running for House District 81, has filed a residency challenge against , the other GOP candidate, charging that Roberts is not a legal resident of the district.

Boedecker filed the challenge Friday morning with the Secretary of State.

Boedecker said that, as of June 1, Roberts declared a homestead exemption for 2832 Hawthorne Dr., which Boedecker asserts is outside of District 81 boundaries.

He also said that Roberts owns another piece of property at 3297 Rose Ridge, which is inside the district. However, Boedecker is asserting that Roberts has failed to make the address her permanent home for at least one year before the election.

Under Georgia law, candidates wishing to hold office as state representative must have maintained a "permanent place of abode" in the district they seek to represent for at least one year prior to the general election. 

Boedeker is seeking a hearing before the Office of Administrative Hearings, at which he said additional evidence will be presented.

Boedeker has retained Douglas Chalmers Jr. as counsel. Chalmers' clients have included a number of elected officials, public advocacy groups, and corporations and trade associations. He was the chief lawyer in Georgia for the 2008 McCain presidential campaign.
