Medical Practice Will Move Onto Old Byrider Site

Use of the J.D. Byrider building on Scott Boulevard was approved following a resolution of parking agreement issues.

Family Practice of Atlanta’s were approved at today's DeKalb County Zoning Board of Appeals meeting after a month’s deferral to tie up loose ends with a parking agreement.

“As I mentioned last time, we were on the cusp of having an agreement. Well, we actually have two now,” said Jim Webb, speaking on behalf of applicant Al Waters, who works at Family Practice of Atlanta.

The two signed parking lease agreements come from the neighboring pawn shop and the church building across the street, which is currently home to Zyka Indian restaurant, Montessori Academy Scott Boulevard and Clarian Place Childcare and Learning Center. However, Webb said only one lease will be selected and recorded with the county court before they begin applying for construction-related permits.

“They’re essentially identical in terms of proximity and in terms of the number of spaces,” he said. The option of using the property across the street “came into play at the last minute.”

If that property is selected, though, it would be for employee use only. Patients would park on-site instead of needing to cross the street.

Chairperson Bonnie Jackson asked about what would happen if either business moved and another one took its place, potentially requesting all of the parking spaces for sole use. Webb answered that the leases are protected for ten years.

Webb said that he has also agreed to various conditions with neighboring Tuxworth Springs Condominiums. Robert Stein again spoke on behalf of Tuxworth Springs to show support for the project and its approval by the board.

After clarifying the plans for parking leases and ensuring that Tuxworth Springs was in approval, the board voted yes without opposition and plans can now proceed.
